Import & Export, NRIs & PIOs

The firm advises two related but distinct constituencies: businesses engaged in cross-border trade in goods and services, and individuals of Indian origin who hold property, family interests, or compliance exposures in India.

On the trade side, the practice covers Customs Act adjudication and appeals before the Commissioner (Appeals) and the CESTAT, Foreign Trade Policy matters before the DGFT, anti-dumping and safeguard duty proceedings before the DGTR, IGCR notifications, advance authorisations, EPCG, and disputes around RoDTEP and the erstwhile MEIS. Classification disputes under the Customs Tariff and valuation challenges under Section 14 of the Customs Act are a routine workload. Show-cause notices from the DRI and Customs Preventive are handled at the reply stage and through the appellate hierarchy. Where a writ is the proper remedy, for instance against a plainly without-jurisdiction provisional attachment, we move the High Court directly.

For NRIs, OCIs, and PIOs, the firm offers a settled set of services. Property litigation is the largest piece: partition suits, recovery of possession from tenants who have stopped paying or relatives who have refused to vacate, encroachment matters, and the patient task of getting mutation and revenue records corrected for non-resident heirs. We draft and execute Powers of Attorney for use in Indian proceedings and advise on the FEMA implications of property purchase, sale, and repatriation of sale proceeds. Succession work, including probate, letters of administration, and contested Wills involving heirs in multiple countries, is run jointly between the New Delhi, Mumbai, and Dubai offices.

Compliance work for NRIs covers FEMA contraventions, NRO and NRE account disputes with banks, OCI re-issuance and miscellaneous services, and tax-residency questions referred to empanelled chartered accountants.
